By purchasing a ticket to or participating in any ZEHN Wellness Club event, you acknowledge and agree to the terms below.

1. The Parties

This Agreement is between ZEHN Wellness Pty Ltd (ABN 75 278 008 826) trading as ZEHN WELLNESS CLUB, including its directors, officers, employees, contractors, facilitators, agents, affiliated practitioners, partner venues and venue owners/operators (collectively referred to as “ZEHN”, “we”, “us”), and you, the participant (“you”).

This Agreement applies to all ZEHN events, sessions, retreats, workshops, activations and experiences you attend now and in the future.

2. Nature of the Activities – Recreational Services

ZEHN provides wellness experiences that constitute recreational services under the Competition and Consumer Act 2010 (Cth) and applicable civil liability legislation.

Activities may include:

• Wood-fired sauna exposure (extreme heat, potentially exceeding 100°C)

• Ice baths and cold-water immersion (including sudden immersion)

• Contrast therapy (alternating extreme heat and cold exposure)

• Breathwork practices (including hyperventilation and breath retention techniques)

• Yoga, movement, stretching and physical exercise

• Use of shared facilities including wet areas, decks, steps and change rooms

These activities involve physical exertion and exposure to extreme environmental conditions.

3. Acknowledgement of Inherent Risks

You acknowledge and understand that participation involves obvious and inherent risks, including but not limited to:

• Heat exhaustion, dehydration, heat stroke or burns

• Hypothermia or cold shock response

• Cardiac events, including irregular heartbeat or cardiovascular stress

• Dizziness, tingling, panic response or loss of consciousness (particularly during breathwork)

• Slips, trips or falls on wet or uneven surfaces

• Muscle strain or physical injury

• Serious injury, permanent disability or death

You acknowledge that:

• These risks are integral to the recreational activity.

• Injury or harm may result from the materialisation of these inherent risks.

• No amount of care, instruction or supervision can eliminate all inherent risks.

You voluntarily choose to participate with full awareness of these risks.

4. Voluntary Participation & Assumption of Risk

You confirm that:

• You are participating freely and voluntarily.

• You have had the opportunity to read this Agreement carefully.

• You understand the risks involved, including the risk of serious injury or death.

• You accept full responsibility for your decision to participate.

You assume all risks associated with participation to the maximum extent permitted by law.

5. Health Declaration

By purchasing a ticket or attending, you confirm that:

• You are 18 years or older.

• You are in good physical and mental health.

• You are not pregnant.

• You are not under the influence of drugs or alcohol.

You confirm that you do not suffer from any condition that may increase risk, including but not limited to:

• Heart disease, cardiac conditions or pacemakers

• High or low blood pressure

• Epilepsy or seizure disorders

• Respiratory conditions (including asthma or COPD)

• Raynaud’s disease

• Diabetes

• Any condition aggravated by extreme heat, cold exposure, breathwork or physical exertion

If unsure, you agree to seek medical advice before participating.

You accept responsibility for monitoring your own condition and agree to cease participation immediately if you feel unwell.

6. Safety Compliance

You agree to:

• Follow all safety instructions and facilitator guidance

• Respect recommended time limits in sauna and ice baths

• Use facilities safely and responsibly

• Refrain from reckless, unsafe or disruptive behaviour

ZEHN reserves the right to refuse participation or remove any participant for safety reasons without refund.

7. Emergency Medical Authorisation

If you become injured or unwell, you authorise ZEHN to obtain medical assistance on your behalf if deemed reasonably necessary.

You accept responsibility for any medical, ambulance or hospital costs incurred.

8. Exclusion of Liability (Recreational Services)

To the maximum extent permitted by law, including Section 139A of the Competition and Consumer Act 2010 (Cth) and applicable civil liability legislation:

You agree that ZEHN is not liable for death or personal injury resulting from the materialisation of an obvious or inherent risk associated with the recreational services provided.

You release and discharge ZEHN from liability for:

• Injury, death or loss arising from the inherent risks of participation

• The materialisation of those risks

• Your voluntary participation in the recreational activities

Nothing in this Agreement excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other legislation that cannot lawfully be excluded, including guarantees that services will be provided with due care and skill.

9. Indemnity

You agree to indemnify and hold harmless ZEHN from any claims, losses, liabilities or expenses (including reasonable legal costs) arising from:

• Your breach of this Agreement

• Your negligent or reckless conduct

• Any claim brought by a third party as a result of your actions

10. Personal Property

You are responsible for your personal belongings. ZEHN is not liable for loss, theft or damage to property.

11. Media Consent

ZEHN may photograph or film events for promotional purposes.

By attending, you grant ZEHN a royalty-free, worldwide licence to use your image and likeness for marketing and promotional use.

If you do not wish to appear in media, you must notify us in writing prior to the event or inform staff upon arrival.

12. No Refund Policy

All ticket purchases are final and non-refundable.

Tickets may be transferred prior to the event by contacting info@zehnmovement.com.

If ZEHN cancels an event due to safety, weather or operational reasons, a credit or reschedule option will be offered.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

14. Governing Law

This Agreement is governed by the laws of Victoria, Australia. Any legal proceedings must be brought exclusively in Victoria.

15. Binding Acceptance

By purchasing a ticket, attending an event, or selecting “I Agree” during registration, you confirm that:

• You have read and understood this Agreement

• You understand you are accepting significant risks

• You understand you are waiving certain legal rights

• Your acceptance is legally binding
